Superflix provides a personalized subscription service that allows our members to access entertainment content (“Superflix content”) over the Internet on certain Internet-connected TVs, computers and other devices ("Superflix ready devices").
These Terms of Use govern your use of our service. As used in these Terms of Use, "Superflix service", "our service" or "the service" means the personalized service provided by Superflix for discovering and accessing Superflix content, including all features and functionalities, recommendations and reviews, our websites, and user interfaces, as well as all content and software associated with our service. References to ‘you’ in these Terms of Use indicate the member who created the Superflix account and whose payment method is charged.
By accessing or using the SuperFlix service, website, and software applications (collectively, the "SuperFlix Service"), you agree to be bound by these Terms of Service. If you do not agree to these Terms, you should not use the SuperFlix Service.
SuperFlix may, from time to time, change these Terms of Service. We will notify you of any material changes by posting the new Terms of Service on the SuperFlix website. Your continued use of the SuperFlix Service after any such changes constitutes your acceptance of the new Terms of Service.
Personal information provided or collected through or in connection with the SuperFlix Service is governed by our Privacy Policy. By using SuperFlix, you agree to the collection and use of your personal information in accordance with our Privacy Policy.
To access the content available on SuperFlix, you must have an internet connection and a SuperFlix subscription. You agree to pay the subscription fees applicable to your selected subscription plan. SuperFlix may change the fees for subscription plans, or add new fees and charges from time to time, but we will give you advance notice of these changes.
The SuperFlix Service and any content viewed through the service are for your personal and non-commercial use only. All content on the SuperFlix Service is the property of SuperFlix or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any content without express written permission from SuperFlix.
SuperFlix reserves the right to terminate or suspend your access to the SuperFlix Service at any time, without notice, for conduct such as: (i) archive, reproduce, distribute, modify, display, perform, publish, license, create derivative works from, offer for sale, or use content and information contained on or obtained from or through the Superflix service; (ii) circumvent, remove, alter, deactivate, degrade, block, obscure or thwart any of the content protections or other elements of the Superflix service, including the graphical user interface, copyright notices, and trademarks; (iii) use any robot, spider, scraper or other automated means to access the Superflix service; decompile, reverse engineer or disassemble any software or other products or processes accessible through the Superflix service; (iv) insert any code or product or manipulate the content of the Superflix service in any way; (v) use any data mining, data gathering or extraction method; (vi) upload, post, e-mail or otherwise send or transmit any material designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment associated with the Superflix service, including any software viruses or any other computer code, files or programs. We may terminate or restrict your use of our service if you violate these Terms of Use or are engaged in illegal or fraudulent use of the service.
To the fullest extent permitted by law, SuperFlix shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of, or inability to access or use, the SuperFlix Service; (ii) any conduct or content of any third party on the SuperFlix Service; (iii) any content obtained from the SuperFlix Service; and (iv) unauthorized access, use, or alteration of your transmissions or content.
These Terms of Service shall be governed by and construed in accordance with the laws of the jurisdiction in which SuperFlix operates, without regard to its conflict of law principles.
